JUDGMENT

This is my judgment in respect of the plaintiffs claim relating to the property in dispute known as Wisma PPP with a Grant No. 27024 Lot 522 Section 69, Bandar Kuala Lumpur, Wilayah Persekutuan (said property) which was purchased by the plaintiff under the name of the 5th defendant and was held on trust by the 5th defendant which was originally the investment company of the plaintiff; and it was transferred by the plaintiff to the 1st defendant and his nominees who are the 2nd and 3rd defendants to be held on

trust for the plaintiff; and the said 5th defendant was to transfer back to the plaintiff upon the payment of a loan advanced by the 1st defendant to the plaintiff for the purchase of the said property. And the plaintiffs claim against the 4th, 6th and 7th defendants in essence is that the 5th defendants shares had been wrongfully acquired by them and in consequence it has to be transferred back to the plaintiff and/or nominees.

This judgment in essence will deal with the agreed issues to be tried as agreed by the plaintiff and the 4th to 7th defendants. The judgment also deals with the 2nd and 3rd defendants counterclaim. The prayers in the statement of claim, i
