A High Court in Orissa has remanded a child custody case back to the Family Court, ordering it to decide on the application for joint custody and visitation rights within four months. The court also granted the appellant interim access to the child under the supervision of a counselor.

The case involved a dispute over child custody and visitation rights. The appeal before the High Court challenged certain paragraphs (11 and 12) of a previous Family Court order. Both parties submitted counter-affidavits and rejoinder affidavits, which the High Court considered.

The High Court, after hearing arguments from both sides, ordered the removal of paragraphs 11 and 12 from the original Family Court order. Crucially, the matter was remanded to the Family Court with instructions to rule on the joint custody and visitation applications within four months.

Therefore, it ordered a supervised meeting facilitated by a counselor attached to the Bhubneshwar Family Court. This first meeting was scheduled for January 21, 2022, at 3:00 PM. The counselor's report will be submitted to the Family Court in a sealed cover, with the Family Court having the authority to decide whether to share the report with the parties. The Family Court also retains the power to issue any interim orders deemed necessary.
