Case Law
Subject : Criminal Law - Bail and Pre-Trial Procedure
Ahmedabad: The Gujarat High Court has issued a notice to the State of Gujarat in response to two applications filed by Ashumal @ Asharam Thaumal Sindhi (Harpalani), popularly known as Asaram. The applications seek regular bail and the modification or deletion of a bail condition related to his 2023 criminal appeal.
A division bench comprising Justice Ilesh J. Vora and Justice R. T. Vachhani has scheduled the matter for further hearing, making the notice returnable on December 1, 2025.
The proceedings stem from Criminal Appeal No. 607 of 2023, filed by Asaram. In connection with this appeal, his legal team has moved two separate miscellaneous applications:
The High Court's order, delivered by Justice Ilesh J. Vora, was brief and procedural in nature. The court directed:
> "Notice returnable on 01.12.2025. Learned APP waives service of notice for the respondent-State."
This signifies that the court has formally taken cognizance of the applications and has called upon the State of Gujarat to respond. The Learned Assistant Public Prosecutor (APP), representing the State, accepted the notice in court, a standard procedure that expedites the legal process.
The issuance of a notice marks the initial step in the adjudication of these applications. The State of Gujarat will now file its response, and the High Court will hear arguments from both the applicant (Asaram) and the respondent (State) on the scheduled date. The court will then decide on the merits of the pleas for bail and the modification of conditions.
