In a significant ruling that reaffirms the sanctity of the right to legal appeal, the Delhi High Court has held that procedural prison rules cannot be used to stifle a detainee’s fundamental right to approach the Supreme Court. Justice Ravinder Dudeja, presiding over the case of Nadeem v. State (Govt of NCT of Delhi) , granted a one-week parole to the petitioner, notwithstanding his failure to meet the statutory one-year incarceration threshold under the Delhi Prison Rules.
The petitioner, Nadeem, currently serving a four-year sentence following his conviction under Sections 392, 411, and 34 of the Indian Penal Code (IPC), sought temporary release to file a Special Leave Petition (SLP) against a High Court judgment that upheld his conviction.
The Home Department of the Government of NCT of Delhi had previously rejected the application, citing Rule 1210 of the Delhi Prison Rules, 2018, which mandates that a convict must serve at least one year of imprisonment before becoming eligible for parole. With only nine months of actual incarceration at the time, the petitioner’s request was dismissed on purely technical grounds.
Counsel for the petitioner argued that the one-year bar should not act as a total denial of justice, asserting that the right to engage counsel of choice for a Supreme Court challenge is an essential facet of Article 21 of the Constitution. The petitioner relied on judicial precedents, including Parsu Ram v. State (GNCT of Delhi) , to argue that filing an SLP constitutes a "special circumstance" requiring a
