Bail Denied: High Court Highlights Importance of Custodial Interrogation in Millet Theft Case

In a recent order, the High Court of Punjab and Haryana at Chandigarh has underscored the significance of custodial interrogation in cases involving organized theft and conspiracy. Presiding over the case of Satyaveer Singh v. State of Haryana , Hon'ble Mrs. Justice Manisha Batra rejected the petitioner's plea for anticipatory bail, prioritizing the investigative necessity of the state over the individual's liberty in this specific instance.

The Disappearing Millet: A Case of Alleged Conspiracy

The case arises from an FIR registered on October 23, 2024, at Police Station City Narnaul, regarding the theft of 100 bags of millet. The complainant, Shri Balaji Transport Company , reported that 700 bags were originally loaded onto a truck for transport to a warehouse in village Jaurasi. Upon arrival, only 600 bags remained. Subsequent investigations led to the arrest of multiple co-accused individuals who, in their disclosure statements, implicated the petitioner—the registered owner of the transport vehicle—in a conspiracy to misappropriate the goods.

Contentions of the Parties

The petitioner argued his innocence, asserting that he was falsely implicated. His counsel maintained that the complainant had hired the vehicle from a co-accused driver, not the petitioner, and that the petitioner had no personal connection with the other accused currently in custody.

Conversely, the State of Haryana, represented by the Assistant Advocate General, argued that the petitioner's involvement was revealed through the conspiracy details provided by co-accused Mali Ram. The prosecution emphasized that the investigation is at a critical juncture, requiring the recovery of the transport vehicle and the remaining 52 bags of stolen millet, alongside the need to unravel the specific modus operandi used by the suspects.

The Court’s Reasoning: Why Custodial Interrogation Matters

The High Court’s decision rested on the principle that statutory powers for grant of pre-arrest bail are not meant to shield suspects from investigation. The Court noted that while the petitioner may not have physically committed the act of theft, prima facie evidence suggested his complicity in a broader conspiracy.

Justice Batra distinguished this case by highlighting that the recovery of primary evidence—the vehicle and the remaining stolen goods—could not be effectively carried out without the petitioner’s physical presence and questioning.

The Court provided critical insights into the necessity of custodial inquiry:

  • "The petitioner was specifically named by the co-accused. He might not be directly involved in the commission of offence of theft but his complicity by hatching a conspiracy in the act of theft is prima facie made out from the allegations in the FIR."
  • "It is well settled that custodial interrogation of a suspected person is qualitatively more elicitation oriented than questioning a suspect who is well ensconced with a favourable order of anticipatory bail."
  • "Many useful information can be disinterred during custodial interrogation."

Final Outcome

Ultimately, the Court concluded that no extraordinary circumstances warranted the grant of anticipatory bail. By dismissing the petition, the Court has reinforced the judicial trend of prioritizing investigative integrity in cases involving organized criminal conspiracies under the Bharatiya Nyaya Sanhita (BNS) , 2023. The petitioner will now be required to cooperate with law enforcement in the ongoing recovery proceedings. Investigations into the role of the transport firm and the chain of custody for the millet are expected to continue.
