High Court Mandates Minimum Stipend for Junior Advocates in Tamil Nadu & Puducherry, Orders Enhanced Welfare Fund

Landmark Judgment: Madras High Court Orders Minimum Stipend for Junior Lawyers and Expedites Welfare Fund Enhancements

Chennai, - In a significant ruling aimed at safeguarding the livelihood of young legal professionals, the Madras High Court has directed the Bar Council of Tamil Nadu and Puducherry to ensure a minimum monthly stipend for junior advocates employed by senior lawyers across the state and union territory. The division bench of Justices S.M. Subramaniam and C. Kumarappan issued these directives while addressing a Public Interest Litigation (PIL) concerning the welfare schemes for advocates.

Addressing Grievances of Junior Advocates

The court observed that despite numerous discussions, the grievances of advocates, particularly junior advocates, remained unaddressed. Acknowledging the crucial role of the legal profession and the influx of young graduates from diverse backgrounds, the court emphasized the need to create a supportive ecosystem for newcomers.

"Young Lawyers today are post with numerous challenges. Their enthusiasm should not be stifled solely because of economic factors," the bench noted, highlighting the alarming trend of youngsters leaving the profession due to financial instability. Rejecting the notion that economic hardship is an inherent part of a junior lawyer's journey, the court firmly stated, "This is wholly unacceptable and demeaning. There is no need for the young Lawyers to get used to anything. Rather, we must ensure that a safe and all conducive atmosphere be provided for their learning and growth in the profession."

Minimum Stipend Directive

Recognizing the cost of living, especially in major cities, the High Court directed the Bar Council to issue guidelines mandating a minimum monthly stipend for junior advocates. The court specified:

  • ₹20,000 per month for junior advocates practicing in Chennai, Coimbatore, and Madurai .
  • ₹15,000 per month for junior advocates practicing in other areas of Tamil Nadu and Puducherry .

The court explicitly stated that this minimum stipend applies to all junior lawyers, irrespective of gender, addressing the prevalent issue of gender pay disparity in the legal profession.

Welfare Fund for Puducherry Advocates

In addition to stipends, the court addressed the long-pending enhancement of the Advocates' Welfare Fund Scheme in Puducherry . The court directed the Bar Council of Tamil Nadu and Puducherry , the Government of Puducherry , and recognized Bar Associations in Pondicherry and Karaikkal to collaborate and finalize the proposal for amending Schedule-I of the Advocates' Welfare Fund Act, 2001, within four months. This amendment aims to enhance the welfare fund scheme amount, benefiting eligible advocates who are awaiting these benefits.

Safeguarding Livelihood as a Constitutional Right

The judgment underscored the constitutional right to livelihood under Article 21, extending it to junior advocates. The court emphasized that utilizing the services of junior lawyers inherently creates a right to be paid for their work. "Once the services of Junior Lawyers are utilised there arises a consequential right on their part to get paid for the services rendered. Though they are here to learn, their livelihood also must be given importance and efforts must be made to ensure that their economic instability do not come in their way of learning," the judgment stated.

Bar Council to Implement Directives

The Bar Council of Tamil Nadu and Puducherry has been directed to issue circulars, instructions, and guidelines within four weeks to implement both the minimum stipend directive and to coordinate the welfare fund enhancement in Puducherry . The court has scheduled the matter for further consideration on June 20, 2024, to review the progress of these directives.

This judgment marks a significant step towards ensuring economic stability and dignity for junior advocates, recognizing their crucial role in the legal system and paving the way for a more equitable and supportive legal profession. The court's proactive measures are expected to have a far-reaching positive impact on the legal fraternity, particularly for first-generation lawyers and those from marginalized backgrounds.
