Chandigarh: The High Court of Punjab and Haryana, in a significant ruling, enhanced the compensation awarded by a Motor Accidents Claims Tribunal (MACT) to the children of a deceased woman, emphasizing that a homemaker's income contribution should be assessed on par with that of a skilled worker. Justice Anoop Chitkara , presiding over the appeal (FAO 2978/2017), also granted enhancements for future prospects and loss of consortium to the dependents.

The deceased was claimed to have been employed as a helper. However, the Tribunal noted that her attendance was formally marked for only one day – the very day of the fatal accident. Consequently, the Tribunal had proceeded to assess her income at Rs. 6,000 per month.
Appellants' Contentions (
Respondents' Submissions ( Sanjay Kumar Yadav & Others): Conversely, the respondents contended that the claimants themselves had initially stated the deceased was earning a salary of Rs. 7,200 per month. Therefore, her income could not be assessed at a higher rate than this figure.
The High Court, after considering the submissions from both sides, sided with the appellants regarding the assessment of the deceased's income and the entitlement to other heads of compensation.
Justice Anoop Chitkara observed, "Even if it is assumed that the deceased was working on a salary of Rs. 7,200/-, but after office work, she was expected to manage the house. A mother of three children will have to manage the house. Hence, her total income cannot be treated less than that of a skilled worker."
The Court proceeded to reassess the compensation based on the following established legal principles:
Income of the Deceased: Taken as Rs. 8,459 per month (minimum wage of a skilled worker).
Future Prospects: An addition of 40% was granted, considering the deceased was 40 years old. This increased the monthly income to Rs. 11,842.60.
Annual Income: Calculated at Rs. 1,42,111.20 (Rs. 11,842.60 x 12).
Deduction for Personal Expenses: 1/3rd was deducted, as per standard norms for dependents.
Net Annual Dependency: Arrived at Rs. 94,740.80.
Multiplier: A multiplier of 15 was applied, appropriate for the deceased's age (40 years).
Loss of Dependency: Calculated as Rs. 14,21,112 (Rs. 94,740.80 x 15).
Loss of Estate: Rs. 15,000 awarded.
Funeral Expenses: Rs. 15,000 awarded.
Loss of Consortium: Each of the three children was awarded Rs. 40,000, totaling Rs. 1,20,000, for loss of parental consortium.

The High Court thus enhanced the compensation payable to the appellants to Rs. 15,71,112. The claimants were also held entitled to interest at the rate of 8% per annum from the date of filing the claim petition until the date of actual payment. The Court maintained any recovery rights previously granted to the Insurance Company.
The appeal was accordingly disposed of, along with any pending miscellaneous applications.
