Case Law
Subject : Insolvency and Bankruptcy - Corporate Insolvency
New Delhi: The National Company Law Tribunal (NCLT) has admitted an insolvency plea filed by Search Pharma Private Limited against retail giant Vishal Mega Mart Private Limited. The case, registered as C.P. (IB) - 206/2024, will now proceed under the provisions of the Insolvency and Bankruptcy Code, 2016.
The matter was brought before the NCLT by Search Pharma Private Limited, which initiated the Corporate Insolvency Resolution Process (CIRP) against Vishal Mega Mart Private Limited. While the specific details of the operational debt and default are not detailed in the initial filing information, the petition indicates a financial dispute between the pharmaceutical company and the retail corporation.
The admission of the plea signifies that the NCLT has found prima facie evidence of a defaulted debt owed by Vishal Mega Mart to Search Pharma, meeting the threshold requirements for initiating insolvency proceedings.
With the admission of the case, the NCLT will likely appoint an Interim Resolution Professional (IRP) to take over the management of Vishal Mega Mart. A moratorium will also come into effect, which will put a stay on all pending lawsuits and legal proceedings against the company, providing a period for debt resolution.
The IRP's primary responsibilities will include taking control of the company's assets, collecting all claims from creditors, and forming a Committee of Creditors (CoC). The CoC will then be tasked with approving a resolution plan to revive the company.
The case marks a significant development for Vishal Mega Mart, a major player in India's retail sector. The proceedings will be closely watched by stakeholders, including suppliers, employees, and financial creditors. The future course of action will depend on the resolution plan formulated and voted upon by the Committee of Creditors under the supervision of the NCLT.
