Therefore, the driving license need not have contained a specific endorsement authorizing the driver to drive an auto-rickshaw. 9. In the present case, the driver of the auto-rickshaw did have a valid driving license for driving a LMV. Hence, the first contention raised by the learned counsel for the Insurance Company is clearly unacceptable.
The first respondent did not have any valid license to drive the auto. 4. The third respondent/Insurance company filed counter and submitted that they did not issue any policy to the vehicle involved in the accident.
Thus, it is clear that he was holding only a non-transport driving license as on the date of accident. The auto being a transport vehicle he was not having valid and effective driving license.
The third respondent, insurer of that vehicle contended that the driver of the goods auto rikshaw was not having a valid license or badge to drive the goods auto rikshaw. The 6th respondent/insurer contended that the driver had no license or authorisation/badge to drive that auto rikshaw. The Tribunal exonerated the insurance company from liability to pay compensation to the claimants and made the owner/insured liable.
