The Price of Innocence: Jammu Court Exposes Tainted Rape Prosecution

In a scathing verdict that has sent ripples through the legal community, a Fast Track Court in Jammu has acquitted a man falsely accused of rape, slamming the investigating agency for a "botched" and "fabricated" case. The judgment not only clears the accused of all charges under Section 376 of the IPC but also demands systemic accountability for those who manipulated the legal process.

The Collapse of a Fabricated Narrative The case originated from a complaint filed in May 2022 , alleging that the accused—the victim's own uncle—had entered a room, committed sexual assault twice, and faced no resistance from other family members residing in adjacent rooms. Presiding Officer Amarjeet Singh Langeh dismantled this narrative, noting that for a 20-year-old victim to remain silent during a midnight assault while family members slept nearby was " patently absurd and palpably improbable ."

The court highlighted the suspicious intervention of external entities, specifically individuals claiming to represent an NGO, who appeared to have driven the filing of the FIR when even the victim’s own mother initially denied that any incident had occurred.

A Case Built on Sand: Medical Discrepancies Perhaps the most damaging evidence against the prosecution was the stark lack of scientific support. Although the victim was medically examined within hours of the complaint, the report found no marks of violence and no physical evidence of recent sexual intercourse.

The court underscored that such total absence of physical indicators directly contradicted the victim's assertions of being overpowered and gagged. This medical void, when coupled with the lack of spontaneous out-cry, left the court with no choice but to conclude that the occurrence simply never took place.

The Puppet Strings of External Influence The investigation was heavily compromised by the roles played by NGO workers, who interfered with police procedures and pushed for the registration of a case against the wishes of the family. The court noted:

"The testimony of this PW (PW 5) clearly shows that even mother of victim asserted before her that no wrong was ever done to PW victim... such intervention by an outside entity raises grave concern about the veracity of prosecution case and potential mis-use of legal process."

The court also identified that the Investigating Officer, PSI Deewanshu Dutt, failed to follow standard protocols, including the failure to seize key evidence like clothing or bedsheets, and an inexplicable 10-day delay in visiting the crime scene.

A Clarion Call for Accountability The accused spent one year, seven months, and eleven days in incarceration—a "crucible of adversity" that the court found deeply unacceptable. In a rare and bold move, the court has ordered the Inspector General of Police to initiate departmental inquiries against the Investigating Officer and the then-SHO of Police Station R.S. Pura. Furthermore, the court directed the Senior Superintendent of Police to investigate the role of the NGO members and initiate criminal action against the complainant for filing a false case under Section 182 of the RPC.
