It emphasized that the material point for determining the applicability of the amended provision is the date of taking cognizance of the offence. The court found that the sanctioning authority had failed to apply its mind adequately to the evidence presented by the CBI, leading to an improper denial of sanction.
The court set aside the order declining prosecution sanction and directed the sanctioning authority to review the CBI's request afresh within three months. It also ordered that further proceedings in the case against the accused be kept in abeyance until a decision is made. This ruling underscores the importance of thorough scrutiny by sanctioning authorities in corruption cases involving public servants.
