Kerala Government Ordered to Release Payment to RITES for Flood Mitigation Report

The Kerala High Court has directed the state government to release payment to RITES, a government-owned enterprise, for a flood mitigation report that it had submitted in 2012.

The government had withheld the payment, arguing that the report did not meet the guidelines of the Ministry of Environment, Forests and Climate Change and the National River Conservation Plan.

However, RITES contended that the report did meet the guidelines and that it had submitted evidence to prove this.

The court agreed with RITES and held that the government had not provided any evidence to support its claim that the report was not in accordance with the guidelines.

The court also noted that the government had not followed the procedure laid down in the agreement between the parties for resolving disputes.

The court directed the government to release the payment to RITES within three months of the date of the judgment.

Background

In 2012, RITES entered into an agreement with the Kerala government to provide a detailed study report and rectification measures for flood mitigation and pollution abatement in respect of Killi and Karamana rivers in Thiruvananthapuram District.

According to RITES, it submitted its reports, but the payments due to it in terms of the agreement have not been paid so far.
