Madras High Court Flags 'Strange' Policy Limiting PE Teachers, Cites Rise in 'Couch Potato' Children

CHENNAI: The Madras High Court has expressed serious concern over a government policy that sanctions a Physical Education (PE) Teacher post only in schools with a minimum of 250 students, describing the restriction as "incongruous" and a threat to the overall development of children.

Justice P.T. Asha, hearing a writ petition filed by The Secretary of S.R.P. Middle School, ordered the Tamil Nadu Education Department to submit a detailed report on its policy regarding the appointment of PE teachers across all types of schools in the state.

Case Background

The case, WP(MD) NO. 20585 of 2017, was brought before the court challenging the restrictive criteria for appointing physical education staff in aided schools. The petitioner's counsel highlighted a paradox: while the state-prescribed syllabus allocates two periods a day for Physical and Health Education, the government's own policy prevents many schools from having a dedicated teacher to conduct these classes.

Court's Strong Observations

Justice Asha made several pointed observations, highlighting the growing health crisis among children. "Today we are faced with children who are couch potatoes and playing online games affecting not only their physical but also their mental state," the order noted. The court expressed alarm over the rise of "child diabetes, depression etc," emphasizing that "an active body is required to have an active mind."

Calling the Education Department's decision "rather strange," the court stated that the absence of physical education would "seriously impede" the overall development of a child.

"That being the case, this restriction placed by the Government appears incongruous... the decision of the Education Department in the opinion of the Court is rather strange because without the physical education, the overall development of a child would be seriously impeded," the court remarked in its order.

Directions and Next Steps

In light of these concerns, the High Court has directed the government to provide a comprehensive report explaining:

1. The policy for appointing PE Teachers in all government, aided, unaided, and corporation schools.

2. The rationale behind imposing the 250-student minimum strength as a prerequisite for sanctioning a PE teacher post.

The court was also informed that the Supreme Court is examining similar issues nationwide and has already received a report from the State of Tamil Nadu. Justice Asha has requested the petitioner's counsel to produce this report for the court's consideration.

The matter has been scheduled for the next hearing on October 10, 2025, when the government is expected to present its report and justify its policy.
