The prosecution, represented by the Additional Public Prosecutor, vehemently opposed the request, citing the gravity of the offences charged under the Protection of Children from Sexual Offences (POCSO) Act, alongside sections of the Indian Penal Code.
Upon reviewing the charge sheet, Justice L. Victoria Gowri found prima facie evidence of serious sexual misconduct. The court noted that the allegations were of such a nature that interference at this stage would be entirely inappropriate.
However, the courtroom atmosphere shifted when the court addressed a grave procedural lapse: the petitioners’ counsel had named the victim as the second respondent in the petition. Under Indian law, the identity of a victim in a POCSO case must remain masked to prevent re-victimization and ensure legal protection. By exposing the victim in the public record, counsel committed a significant breach of professional and legal conduct.
