Privacy Over Procedure: Madras HC Penalizes Counsel for Exposing POCSO Victim’s Identity

In a stern reminder of the legal system’s duty to protect vulnerable litigants, the Madurai Bench of the Madras High Court has dismissed a petition seeking to quash a final report in a POCSO case, concurrently imposing a heavy cost on the counsel who revealed the victim's identity in court filings.

Presided over by the Hon'ble Mrs. Justice L. Victoria Gowri, the court underscored that the sanctity of victim privacy in sexual offence cases is absolute, far outweighing the procedural arguments presented by the petitioners.

The Conflict: A Plea to Quash

The case involved six petitioners, including family members of the victim, who moved the court under Section 528 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023. They sought to quash the final report pending before the Principal Special Court for Exclusive Trial of cases under the POCSO Act, Madurai, alleging that they had been falsely implicated in the underlying criminal proceedings (Crime No. 351 of 2022/Crime No. 19 of 2024).

The prosecution, represented by the Additional Public Prosecutor, vehemently opposed the request, citing the gravity of the offences charged under the Protection of Children from Sexual Offences (POCSO) Act, alongside sections of the Indian Penal Code.

Court’s Reasoning: Allegations and Oversight

Upon reviewing the charge sheet, Justice L. Victoria Gowri found prima facie evidence of serious sexual misconduct. The court noted that the allegations were of such a nature that interference at this stage would be entirely inappropriate.

However, the courtroom atmosphere shifted when the court addressed a grave procedural lapse: the petitioners’ counsel had named the victim as the second respondent in the petition. Under Indian law, the identity of a victim in a POCSO case must remain masked to prevent re-victimization and ensure legal protection. By exposing the victim in the public record, counsel committed a significant breach of professional and legal conduct.

Key Observations

The High Court minced no words in its rebuke of the lapse:

  • On the Seriousness of Charges: "On a careful reading of the charge sheet, it is evident that there is a clear allegation of having indulged in sexual activities against the victim. In view of the seriousness of the allegations, this Court is not inclined to interfere with the same."
  • On Professional Misconduct: "That apart, this Court strongly condemns the conduct of the petitioners’ counsel for having mentioned the name of the victim as the second respondent."
  • The Penalty: "In view of the same, this Court is inclined to impose a cost of Rs.25,000/- (Rupees Twenty Five Thousand only) on the petitioners."

The Verdict and Its Impact

The court dismissed the criminal original petition and ordered the petitioners to pay ₹25,000 to the victim via demand draft by February 12, 2026. Furthermore, the Registry of the High Court was directed to scrub the record of the victim’s name, replacing it with 'XXXXX' to safeguard her identity.

This ruling serves as a vital signal to legal practitioners: while the rights of the accused to seek legal remedies remain intact, those rights cannot be exercised at the cost of the safety and anonymity of vulnerable victims. Any failure to uphold these privacy standards will be met with firm judicial intervention and financial liability. The matter has been posted for 'Reporting Compliance' on February 12, 2026, to ensure the court’s orders are strictly adhered to.
