Co-op Society Election Results to be Declared as Karnataka High Court Dismisses Members' Plea to Vote

Dharwad, Karnataka – The Karnataka High Court has ordered the announcement of election results for The Taluka Agricultural Producer Co-operative Marketing Society in Bagalkot, after dismissing a writ petition filed by over 160 members who sought inclusion in the voter list. The court, presided over by Justice Ashok S. Kinagi, declared the petition infructuous as the election date had already passed.


Background of the Case

A group of 168 individuals, led by petitioner Basavaraj S/o Nagappa Sounshi, approached the High Court with a grievance regarding their exclusion from the final voter list for the society's management committee elections. The petitioners, all members of the co-operative society, had filed a writ petition seeking a direction (mandamus) to the election authorities.

Their primary prayer was to have their names included in the 'C Category' individual members' eligible voter list and to be permitted to cast their votes in the election scheduled for August 23, 2025.

Arguments and Court's Observation

When the case, Basavaraj S/o Nagappa Sounshi vs State of Karnataka , came up for preliminary hearing on September 1, 2025, the central issue was the timing of the legal challenge versus the election schedule.

The petitioners' counsel acknowledged that the primary relief sought—the right to participate in the election—could no longer be granted. He submitted before the court that "in view of passage of time, the writ petition has become infructuous."

An infructuous petition is one where the subject matter of the dispute has ceased to exist, or the relief sought has become impossible to grant due to subsequent events. In this instance, the election had already taken place on August 23, 2025, rendering the plea to be allowed to vote moot.

Court's Final Order

Accepting the submission made by the petitioners' counsel, Justice Ashok S. Kinagi delivered a concise oral order. The court formally placed the submission on record and proceeded to dismiss the writ petition on the grounds of it having become infructuous.

The judgment stated:

"Learned counsel for the petitioners submits that, in view of passage of time, the writ petition has become infructuous. The said submission is placed on record. Accordingly, the writ petition is dismissed as having become infructuous."

Implications and Direction to Announce Results

With the dismissal of the petition, the legal hurdle preventing the finalization of the election process was removed. The court issued a consequential direction to the Returning Officer to proceed with the next step.

"The Returning Officer is directed to announce the result of the election held on 23.08.2025," the order concluded.

This decision clears the way for the declaration of the new committee of management for the Bagalkot-based co-operative society, bringing a close to the electoral dispute that had reached the High Court.
