COMPLAINT AND REQUEST FOR REGISTRATION OF A FIRST INFORMATION REPORT UNDER SECTIONS 323, 324, AND 506 OF THE INDIAN PENAL CODE, 1860

COMPLAINANT

Noushad, aged 56 years, Son of Muhammed, residing at Chulikkottil House, Marithazham Post, Ernakulam District, PIN – 683572.

ACCUSED
Bilal Babuji, aged 32 years, Son of Babuji, residing at Arupuzha House, Veloor Village, Kottayam Taluk, Kottayam District.

1. I, the complainant, Noushad, hereby submit this complaint and pray for the registration of a First Information Report against the above-named accused for offences punishable under the Indian Penal Code, 1860, arising from a violent assault on my person.

2. I am a resident of the above-mentioned address and live with my family. My spouse and I operate a modest retail establishment at Millungal Junction, Kanjiramattom, which constitutes our sole means of livelihood.

3. In the month of March 2026, the accused, Bilal Babuji, procured merchandise valued at Rs. 137/- on credit from my establishment. He represented to my spouse that he would remit the sum directly to me.

4. On the 17th day of June, 2026, in the morning, I encountered the accused in the vicinity of the Akshaya Centre at Millungal Junction, Kanjiramattom. The accused deliberately evaded me and refused to discharge the outstanding monetary liability. Upon demanding payment, the accused raised his voice in a manner intended to cause public humiliation. Thereupon, without any provocation or justification, the accused resorted to violence and inflicted blunt force trauma to my face. I sustained a nasal haemorrhage and lost consciousness. While I was incapacitated on the ground, the accused proceeded to deliver forcible kicks to my chest and other regions of my body. The assault was witnessed by several bystanders, who subsequently conveyed me to the Public Health Care Centre at Keechery. The medical practitioner at that facility referred me to a tertiary care hospital. I was thereafter transported to AP Varkki Hospital and subsequently to JMP Medical Centre at Piravom for advanced diagnostic imaging, including a CT scan. Owing to the severity of the cranial injury sustained, I was admitted to INDO AMERICAN HOSPITAL, INSTITUTE OF BRAIN AND SPINE, on the 17th day of June, 2026, at approximately 11:30 a.m. I remained an inpatient for a period of three days and was discharged on the 19th day of June, 2026. The aggregate medical expenditure incurred exceeds Rs. 3,50,000/-.

5. Subsequent to the incident, I filed a complaint at the Mulanthuruthy Police Station on the 17th day of June, 2026. Despite multiple notifications from three medical institutions to the police authorities, no police officer attended the hospital or interviewed me. The police have declined to register a cognizable case, and the circumstances indicate the involvement of corrupt practices. Under duress and coercion exerted by the accused, I was compelled to visit the police station and was informed that the matter had been amicably settled and that a sum of Rs. 2,00,000/- would be tendered to cover my medical expenses. I did not accede to this compromise proposal. I expressly demanded that the police register a First Information Report and initiate a formal investigation, yet no remedial action has been undertaken by the law enforcement authorities to date.

6. The accused perpetrated an unprovoked and malicious assault upon the complainant, resulting in grievous bodily trauma to the facial region, thoracic area, and other parts of the body. The severity of the injuries sustained is corroborated by the medical certificate issued by the treating physician and the comprehensive hospital treatment records.

7. The Station House Officer of the Mulanthuruthy Police Station is statutorily bound under the Code of Criminal Procedure, 1973, to register a First Information Report and to conduct a thorough investigation into the commission of cognizable and non-bailable offences.

8. In light of the foregoing facts and circumstances, I earnestly request that this Hon'ble Superintendent of Police be pleased to examine the merits of this complaint, direct the registration of a First Information Report against the accused, and initiate appropriate legal proceedings to ensure that the accused is brought to justice and subjected to the penalty prescribed by law.
