Punjab & Haryana High Court Boosts Accident Victim's Compensation to Over ₹5.6 Lakhs

Chandigarh: The High Court of Punjab and Haryana, in a significant decision, has substantially enhanced the compensation awarded to an agriculturist, Ram Mehar , who suffered severe and permanent injuries in a road accident in 1998. Justice Jaswant Singh , presiding over the appeal (FAO No. 728 of 2001), increased the total compensation from the ₹1,68,561 awarded by the Motor Accident Claims Tribunal to ₹5,61,800, payable with 6% annual interest from the date of filing the claim petition.

Case Background: A Life Altered by Negligence

The appellant, Ram Mehar , was an agriculturist who met with a serious accident on May 23, 1998. While riding as a pillion passenger on a motorcycle, he was struck from behind by a car (Reg. No. HR-06A-3109) driven negligently by Gajinder Singh , who was also the owner. The accident left Mehar with multiple grievous injuries, including fractures to his right femur and both bones in his leg, leading to a 60% permanent disability as certified by a Medical Board.

The victim underwent prolonged medical treatment, including four surgeries, over a period of 1.5 years. The severity of his condition was underscored by medical testimony indicating a persistent gap in his tibia requiring further surgical intervention. Due to the accident and ensuing medical costs, Mehar , who owned 3 acres of land and 10 buffaloes, was forced to sell his assets.

The Claims Tribunal had initially awarded him ₹1,68,561, which included ₹1,18,561 for medical treatment. Dissatisfied with this amount, Mehar appealed to the High Court seeking enhancement.

Appellant's Plea for Enhanced Compensation

Learned counsel for Ram Mehar argued before the High Court that the Tribunal had failed to adequately compensate for several crucial aspects: * Future medical expenses. * Attendant charges, transportation costs. * Pain and suffering, and loss of amenities. * Future loss of income, given the permanent disability impacting his agricultural work. The Tribunal had awarded only ₹10,000 for loss of income during treatment and ₹60,000 for disability, with no provision for future income loss.

High Court's Re-assessment and Enhanced Award

The High Court meticulously re-evaluated the compensation, noting that the negligence of the car driver was not in dispute as the owner/driver and insurer had not appealed the Tribunal's initial finding.

Key aspects of the High Court's re-assessment included:

Functional Disability: The Court observed Ram Mehar 's heavy limp during his appearance and, considering his profession as an agriculturist reliant on physical labor, assessed his functional disability at 50%.

Loss of Future Income: Taking the appellant's monthly income as ₹3,000 at the time of the accident (age 30), the Court incorporated 30% for future prospects. Applying a multiplier of 17, the loss of future income due to disability was calculated at ₹3,97,800. > The judgment noted: "His entire work is based on physical activity, which involves physical hard work. His functional disability is required to be assessed...Keeping in view the facts of the case, the functional disability of the appellant is assessed @ 50%."

Loss of Income During Treatment: The Court found that the Tribunal erred in awarding only ₹10,000 for loss of income during the 1.5 years of hospitalization. This was revised to ₹54,000 (₹3,000/month for 18 months).

Future Medical Expenses: Recognizing the need for ongoing medical care, including potential further surgery, the Court awarded ₹1,00,000 under this head.

Conventional Heads: Compensation for pain and suffering was increased to ₹60,000. Similarly, significant enhancements were made for attendant charges (₹60,000), transportation charges (₹60,000), and loss of amenities (₹60,000).

Medical Expenses Incurred: The amount of ₹1,18,561 for medical expenses already incurred was maintained.

Final Adjudication

Based on this comprehensive re-evaluation, the High Court determined the total payable compensation to be ₹5,61,800 . This represented an enhancement of ₹3,93,239 over the Tribunal's award.

The Court directed that the enhanced amount be paid to the appellant along with interest at the rate of 6% per annum from the date of filing the claim petition until the date of actual payment. All pending miscellaneous applications were also disposed of with this order dated November 06, 2015.
