In a significant ruling for in-service medical professionals, the Rajasthan High Court has intervened to ensure that administrative convenience does not impede the academic growth of doctors. Justice Dr. Nupur Bhati, presiding over the Jodhpur Bench, directed the state authorities to relieve Dr. Vimla Kumawat, a Medical Officer, to allow her to pursue a Senior Residency Course—a vital step for her career progression as a potential Assistant Professor.
Dr. Kumawat, having completed her PG course, was selected for the Senior Residency program strictly on merit following her performance in NEET-PG related assessments. Despite a state circular from July 2022 explicitly promising to relieve candidates selected for higher studies, the Department of Medical and Health Services denied her request. The State justified this stance by citing an acute shortage of doctors, claiming that releasing her would be detrimental to public health services in a time of administrative exigency.
The petitioner’s counsel argued that the denial of relief was not only contrary to the government’s own policy but threatened the doctor with irreparable career damage. The state, conversely, contended that with over 450 doctors seeking residency and 800 pursuing post-graduation, the healthcare system would be paralyzed if all simultaneously opted for study leave.
However, the Court pointedly noted that the state’s defense rested on "bald assertions" without sufficient data to prove that the loss of one doctor would break the public healthcare system.
The cornerstone of the judgment is the recognition that professional advancement for doctors is a public good, not a private indulgence. Justice Bhati framed the issue through the lens of constitutional imperatives, asserting that the refusal of study leave solely on the grounds of administrative inconvenience fails to account for the long-term benefits of a highly skilled medical workforce.
"Advancement in medical education ultimately strengthens the public healthcare system itself," the Court emphasized, highlighting that doctors who obtain higher qualifications return to serve the public with enhanced expertise.

The High Court has directed the respondents to relieve Dr. Kumawat by February 25, 2026, ensuring she does not lose her seat in the residency program. By prioritizing the petitioner's career rights over the state’s vague administrative concerns, the Court has signaled a shift toward protecting the educational aspirations of healthcare workers, who are the backbone of the state’s medical infrastructure. This decision serves as a reminder that administrative exigency is not a blank check for the state to curtail the professional growth of its employees.
