Hashtags: #CriminalLaw #ForensicEvidence #IndianLegalSystem

Background

On August 9th, 2024, a lady doctor was brutally raped and murdered at R.G. Kar Medical College & Hospital in Kolkata. Her father filed a complaint, leading to a police investigation, the formation of a Special Investigation Team (SIT), and ultimately, the Central Bureau of Investigation (CBI) taking over the case. Sanjay Roy , the then-Principal of RGKMCH, and Abhijit Mondal (the then OC Tala PS) were arrested, along with another accused, Sanjay Roy . The case centered on whether the prosecution could prove beyond a reasonable doubt that Sanjay Roy committed the crime based on circumstantial evidence.

Arguments

The prosecution presented a mountain of circumstantial evidence: CCTV footage placing Roy near the crime scene around the time of the murder, DNA evidence (saliva and hair) linking Roy to the victim, witness testimonies from hospital staff detailing the discovery of the body and the injuries, and expert medical opinions confirming the cause of death as manual strangulation and smothering, along with sexual assault. The prosecution argued that this chain of evidence, while circumstantial, was irrefutable.

The defense argued that the investigation was flawed, pointing to inconsistencies in witness statements, potential contamination of forensic samples, and the lack of direct evidence. They challenged the reliability of the CCTV footage and the DNA evidence, suggesting the possibility of planting evidence to frame Roy . They also argued that the prosecution failed to establish a clear motive.

Court's Analysis and Reasoning

The court meticulously analyzed the evidence, acknowledging some shortcomings in the initial police investigation. However, the judge found the prosecution's circumstantial evidence compelling. The court highlighted the consistency of the witness accounts, the strength of the DNA evidence (despite acknowledging potential contamination in some samples), and the expert medical opinions confirming the cause of death and the sexual assault. The court also noted the accused's unconvincing explanations for his presence at the hospital and the inconsistencies in his statements. The judge emphasized that the burden of proof rested on the accused to provide an alternative explanation for the evidence against him, a burden he failed to meet.

Decision

The court found Sanjay Roy guilty of rape and murder under sections 64/66/103(1) of the Bengal National Security Act (BNS). While acknowledging the flaws in the initial investigation, the judge deemed the cumulative circumstantial evidence sufficient to prove guilt beyond a reasonable doubt. Roy was sentenced to life imprisonment for each charge, to run concurrently, along with significant fines. The court also recommended substantial compensation to the victim's family. The judgment highlights the power of circumstantial evidence in securing convictions in serious crimes, even when investigative processes are not perfect. It also underscores the importance of thorough forensic analysis and the need for improved investigative practices in sensitive cases.
