Telangana High Court Declares Section 10-A of Employment Act Unconstitutional

Background

In a significant ruling on November 19, 2024, the Telangana High Court addressed the constitutionality of Section 10-A of the Telangana (Regulation of Appointments to Public Services and Rationalization of Staff Pattern and Pat Structure) Act, 1994 . The case involved multiple writ petitions filed by V. Praveen Kumar and others, challenging the validity of this section, which aimed to regularize the services of individuals appointed on a contractual basis in government positions.

Arguments

The petitioners, comprising unemployed youth with relevant qualifications, argued that the government had made illegal appointments without following the prescribed recruitment procedures outlined in the Andhra Pradesh Education Service Rules. They contended that Section 10-A was inserted without proper authority and violated their fundamental rights to fair consideration for public employment.

Conversely, the State of Telangana defended the provision, asserting that it was enacted under Section 101 of the Andhra Pradesh Reorganisation Act, 2014, which allowed for adaptations of existing laws. The government claimed that the regularization of contractual employees was a necessary measure to address staffing needs in the newly formed state.

Court's Analysis and Reasoning

The court meticulously analyzed the arguments, emphasizing that Section 10-A could not override existing statutory rules governing public employment. It highlighted that the insertion of this section was not a valid exercise of legislative power, as it failed to amend or repeal the existing Education Service Rules. The judges referenced the Supreme Court's ruling in the Umadevi case, which established that public employment must adhere to fair and transparent procedures.

The court concluded that the regularization of contract employees under Section 10-A was unconstitutional, as it undermined the principles of equality and meritocracy enshrined in Articles 14 and 16 of the Constitution.

Decision

Ultimately, the Telangana High Court declared Section 10-A of the Act of 1994 as ultra vires and set it aside. However, the court decided not to terminate the already regularized contractual employees, recognizing the potential hardship this would cause. Instead, it mandated that future appointments must be conducted in accordance with established laws and procedures, ensuring that all eligible candidates have a fair opportunity to apply for government positions.

This ruling reinforces the importance of adhering to legal frameworks in public employment and upholds the rights of qualified individuals seeking government jobs.
