The Supreme Court of India recently issued an order emphasizing the importance of timely filing of documents, particularly in Special Leave Petitions (SLPs). The order, which does not identify specific parties beyond the petitioner and respondent, highlights the recurring issue of advocates filing crucial documents at the last minute, causing significant inconvenience to the court.
The court noted a concerning trend: advocates often submit additional documents only at the time of the SLP hearing, despite the petitions being filed much earlier. This practice, the order states, is unacceptable. Paragraph 3 of the order explicitly states: "Normally, all documents if any, which, according to the counsel for the petitioner, are relevant and/or material and which are part of the proceedings before the Court, shall have to be filed along with the Special Leave Petition itself particularly when reliance is placed on the said documents." The court highlighted the considerable inconvenience this causes, especially when documents arrive late at night before a hearing.
In response to this issue, the court issued a clear directive. All relevant documents, including additional documents, should be filed alongside the SLP. If this is not possible, applications for additional documents must be submitted well in advance, allowing sufficient time for review. The court suggested consideration of Order 41 Rule 27 of the CPC where applicable. The Registry was instructed to send a copy of this order to the President of the Supreme Court Advocates-on-Record Association to ensure its dissemination to all advocates.
While the order primarily focuses on procedural matters, the underlying case involved a request to vacate or modify an injunction granted by a High Court. The petitioner's senior advocate argued that the injunction affected third parties who had already executed sale agreements. The Supreme Court, having noted these submissions and recognizing the lack of sufficient time to review additional documents, allowed the petitioner to file a review application with the High Court to address these issues. The High Court was directed to consider this application within four weeks of its filing. The SLP itself was then disposed of.
This order carries significant implications for legal practice before the Supreme Court. It emphasizes the importance of procedural efficiency and respect for the court's time. The court’s action serves as a reminder of the need for meticulous preparation and timely filing of all relevant documents in SLPs, preventing last-minute rushes and ensuring the efficient administration of justice. The order's clear direction is intended to improve the overall functioning of the court and to prevent future instances of last-minute document filings.
