The Supreme Court, relying on its own previous order dated January 10, 2022, in Miscellaneous Application No. 21/2022, reversed the High Court's decision. This prior order excluded the period from March 15, 2020, to February 28, 2022, for the purposes of limitation in all judicial and quasi-judicial proceedings. The Supreme Court held that this exclusion applied to the limitation period under the Commercial Courts Act, 2015, as well.

A pivotal excerpt from the Supreme Court's judgment reads: "In that view of the matter, the period from 15.03.2020 till 28.02.2022 shall have to be excluded for the purposes of limitation as may be prescribed under any General or SPECIAL LAWS in respect of all judicial or quasi-judicial proceedings...The impugned judgment and order passed by the High Court refusing to condone the delay and take on record the written statement is hereby quashed and set aside."

The Court directed that the written statement be taken on record and considered accordingly. Furthermore, it ordered the trial court to expedite the pending interim injunction application, directing a final decision within six weeks.
