Supreme Court Stays Meghalaya High Court Order on Assam - Meghalaya Boundary MoU

The Supreme Court of India has stayed an interim order by the Meghalaya High Court that effectively halted the implementation of a Memorandum of Understanding (MoU) between the states of Assam and Meghalaya regarding their long-standing border dispute. The MoU, signed on March 29, 2022, by the Chief Ministers of both states in the presence of the Union Home Minister, aimed to resolve boundary issues in six areas.

The Case

Four citizens of Meghalaya filed a writ petition in the Meghalaya High Court challenging the validity of the MoU. A single judge of the High Court, on December 8, 2022, issued an interim order preventing any physical demarcation or erection of boundary posts until further notice. The State of Meghalaya appealed this interim order to a Division Bench of the High Court, which subsequently decided to hear the writ petition.

The State of Meghalaya argued that the MoU, while not resolving all border disputes, represented a significant step towards addressing long-standing issues hindering development in the contested areas. The lack of clear demarcation, they contended, prevented residents from accessing government schemes.

Assam , notably absent from the initial High Court proceedings, argued that the interim order was issued without proper notice. The petitioners contended that the MoU infringed upon Article 3 of the Constitution, which deals with the formation of new states and alteration of areas, boundaries, or names of existing states.

The Supreme Court's Decision

The Supreme Court, hearing the Special Leave Petition filed by the State of Meghalaya , found that the single judge of the Meghalaya High Court had not provided sufficient reasons for the interim order. While reserving the question of whether the MoU required parliamentary approval for later consideration, the Court deemed the interim order staying the MoU's implementation unwarranted.

The Court's judgment highlighted the lack of notice to Assam in the High Court proceedings and the absence of justification for the interim order. The Solicitor General, representing the Union of India, argued that the MoU doesn't aim to alter state boundaries, merely demarcate existing ones in specific areas.

Crucially, the Supreme Court's order stayed the operation of the High Court's interim order, effectively allowing the implementation of the MoU to proceed. This decision is likely to have significant implications for border relations between Assam and Meghalaya , enabling further progress in resolving the long-standing boundary issues. The Supreme Court has listed the matter for further hearing on January 23, 2023.

Implications

The Supreme Court's decision represents a significant victory for both states seeking to resolve their border dispute. It allows for the implementation of the MoU and paves the way for the resolution of the long-standing border issue between Assam and Meghalaya .
