The appellant argued that the responses received from the Public Information Officer (PIO) were incomplete and that there was a delay in transferring his RTI applications to the appropriate authorities. The CIC analyzed the arguments presented by both sides, noting that the PIO had furnished replies based on the records available. The Commission highlighted that the PIO is not obligated to create information or provide details beyond what is documented. It was also emphasized that the appellant had the responsibility to pursue appeals with the concerned First Appellate Authority (FAA) if dissatisfied with the responses received.
The CIC ruled in favor of the MCD, stating that the information was provided as per the RTI Act, and there was no delay in the process. The appeals were disposed of, affirming the duty of the PIO to communicate existing information rather than generate new data. This decision reinforces the framework of the RTI Act, ensuring that public authorities remain accountable while also delineating the limits of information provision.
