In an appeal against acquittal, it would not be legally sufficient for High Court to take a contrary view about credibility of witnesses.
The prosecution must prove guilt beyond reasonable doubt, and inconsistencies in eyewitness testimony undermine the case against the accused.
(1) Court cannot convict accused on the basis of principles of preponderance of probability – It is duty of Court to make sure that miscarriage of justice is avoided at all costs and benefit of doubt....
Murder – Conviction has to be based on evidence which proves accused guilty beyond reasonable doubt.
Accused cannot be convicted on the ground of suspicion, no matter how strong it is – There is not only a grammatical but a legal distinction between ‘may be proved’ and ‘must be or should be proved’.
Murder – In a case involving gruesome broad daylight double murder by repeated gun firing, it is unlikely that any of persons from neighbourhood, would have courage to step forward as witnesses.
Murder - Unless eyewitnesses identify accused present in Court, it cannot be said that, based on testimony of eyewitnesses, guilt of accused has been proved.
Appeal against acquittal – Appellate Court cannot overturn order of acquittal only on the ground that another view is possible – Judgment of acquittal must be found to be perverse.
The appellate court upheld the trial court's acquittal due to insufficient evidence and contradictions in witness testimonies, reinforcing the presumption of innocence.
