The court carefully examined the arguments from both sides and noted that the applicant's retirement benefits had been adversely affected by the impugned orders. It highlighted that any action taken to reduce pay or recover amounts from an employee post-retirement could be deemed punitive and must adhere strictly to legal standards and principles of fairness. The tribunal referenced previous judgments, emphasizing that recovery actions must not violate established legal protections for employees.
Ultimately, the court quashed the contested orders and directed the respondents to restore the applicant's pay as per the earlier fixation, along with all consequential benefits, including the re-fixation of retirement benefits with arrears. The tribunal mandated that the recovery amount be refunded with interest at the GPF rate. The respondents were instructed to complete this process within three months of receiving the certified copy of the order.
This ruling reinforces the importance of adhering to legal principles in administrative decisions, particularly concerning employee rights and benefits.
