In a significant ruling, the High Court of Judicature at Allahabad has denied anticipatory bail to a petitioner involved in a corruption case under the Prevention of Corruption Act, 1988. The case, identified as Crime No. 320/2020, has progressed to Sessions Case No. 941/2024 following the filing of a charge-sheet. The petitioner is accused of possessing assets disproportionate to his known sources of income, amounting to over Rs. 1.5 crore during the period from 2002 to May 2009.

The petitioner’s counsel, Mr. Sanjay Mani Tripathi , argued that the customary practice in Uttar Pradesh is to effect arrests only after a charge-sheet is filed and the court takes cognizance. He contended that the Investigating Officer had the opportunity to arrest the petitioner during the investigation but chose not to do so. On the other hand, Mr. Akshat Tiwari , representing the State, maintained that the evidence warranted the denial of bail and that the petitioner should be held accountable for the alleged corruption.
