Background

In a significant ruling, the Hon'ble Tribunal addressed the appeal filed by AGP CGD India Private Limited against the Petroleum and Natural Gas Regulatory Board (PNGRB). The case arose when AGP CGD, the authorized entity for the Kanchipuram District's City Gas Distribution (CGD) network, contested the actions of Hyundai India Motor Limited and Indian Oil Corporation Limited ( IOCL ), which had entered into an agreement for the supply of natural gas, allegedly infringing AGP CGD's exclusivity rights.

Arguments

AGP CGD argued that the PNGRB's dismissal of its complaint as premature was erroneous, asserting that it held marketing and infrastructural exclusivity in the Kanchipuram District. The company contended that the supply of natural gas to Hyundai by IOCL violated its rights under the PNGRB Regulations. Conversely, Hyundai and IOCL maintained that their agreement was permissible under the regulations, claiming that the supply arrangement did not infringe upon AGP CGD's rights.

It emphasized that the regulation grants discretion to consumers with natural gas requirements exceeding 50,000 SCMD to choose their supplier. The Tribunal highlighted the importance of maintaining the exclusivity rights of the authorized entity to ensure the viability of the CGD infrastructure and uphold safety standards.

The court directed IOCL to cease its supply of natural gas to Hyundai within one month, reinforcing the exclusivity provisions of the PNGRB Regulations.
