The court analyzed the arguments presented by both parties and highlighted the lack of due process in the withdrawal of the promotion. It noted that the respondents failed to provide any reasons for the withdrawal and did not adhere to the principles of natural justice, which require that individuals be given a fair opportunity to present their case before adverse actions are taken against them.
Furthermore, the court found that the petitioner was indeed the only candidate who met the qualifications for the Pump Operator position, as outlined in the relevant government regulations. The court emphasized that the promotion had been made against a sanctioned post and after thorough consideration of the petitioner's qualifications.
Ultimately, the court ruled in favor of the petitioner, declaring the withdrawal of the promotion order as illegal and invalid. The court ordered the respondents to reinstate the promotion and grant all benefits associated with the Pump Operator position from the date of the original promotion until the petitioner was promoted again in 2008. The court mandated that necessary calculations and benefits be released to the petitioner within three months of receiving the certified copy of the order.
This ruling underscores the importance of due process in employment matters and reinforces the rights of employees to fair treatment in promotion decisions.
