They also claimed that interest on the compensation should be calculated from the date of possession rather than the date of notification.
Conversely, the State's counsel maintained that the assessment of the land's value was appropriate and that the Reference Application filed by the appellants was not maintainable as it was submitted beyond the six-month period stipulated by the Land Acquisition Act.
The court meticulously reviewed the evidence presented by both parties, noting that the appellants failed to provide sufficient evidence to support their claim regarding the market value of the land. The court emphasized that the assessment of compensation must consider various factors, including the specific characteristics of the land and its location.
The court found that the Additional District Judge had correctly determined that the possession of the land was taken in April 2002 and awarded interest at the rate of 12% per annum from that date until the compensation was deposited. However, the court noted that the interest should have been calculated at 9% for the first year and 15% thereafter, as per the provisions of Section 34 of the Land Acquisition Act.
Ultimately, the High Court allowed the appeal in part, affirming the Additional District Judge's findings regarding the date of possession and the assessment of compensation based on the guidelines issued by the Registrar. The court ordered that the interest on the compensation be recalculated in accordance with the statutory provisions, ensuring that the appellants receive fair compensation for their acquired land.
This ruling underscores the importance of accurate evidence in land acquisition cases and clarifies the application of interest rates in compensation assessments, reinforcing the rights of landowners in such proceedings.
