In a significant ruling, the Madras High Court addressed the appeal of an individual convicted for rash and negligent driving that led to the death of a man and the killing of six cows. The appellant was originally sentenced to one year of simple imprisonment and fines under Sections 279 and 304(A) of the Indian Penal Code (IPC). Following a series of appeals, the High Court modified the sentence to three months of simple imprisonment.

The prosecution argued that on January 9, 2013, the appellant drove his lorry recklessly, resulting in a fatal accident on the Nilakottai to Madurai road. Witnesses testified that the appellant's driving was negligent, leading to the death of Karthik and the death of several cows. The defense contended that the cattle were running on the road, causing the accident, and sought to absolve the appellant of the charges.

Court's Analysis and Reasoning

The court examined the evidence presented by multiple eyewitnesses, who consistently stated that the appellant's driving was indeed rash and negligent. The court noted that the witnesses denied any claims that the cattle were the cause of the accident. While the court upheld the conviction, it acknowledged the significant time elapsed since the incident—over eleven years—and the fact that the appellant had been on bail throughout the proceedings.

The court also considered the appellant's offer to deposit Rs. 1,00,000 as compensation for the deceased's family, which was accepted and placed in a fixed deposit pending distribution.

Decision

Ultimately, the High Court upheld the conviction but set aside the sentence of three months simple imprisonment and the associated fines. Instead, it ordered that the deposited amount of Rs. 1,00,000, along with accrued interest, be paid to the mother of the deceased as compensation for her loss. This decision reflects the court's exercise of discretion under Section 357(3) of the Criminal Procedure Code, aiming to balance justice for the victim's family with the circumstances surrounding the case.

The matter is set to be reviewed again in February 2025 to ensure compliance with the court's directives regarding the compensation payment.
