The petitioner argued that her absence was due to her son's medical treatment and claimed that the rejection of her leave application was done with malice. She contended that she was not properly notified of the requisition for the No-Confidence motion and was deprived of her right to speak during the meeting. Conversely, the respondents maintained that the petitioner had been duly informed and had failed to attend the meetings despite knowing her leave was not approved.
The court analyzed the procedural aspects of the No-Confidence motion under the Maharashtra Village Panchayat Act. It emphasized that the Tahsildar was obligated to convene the meeting within seven days of receiving the requisition. The court found that the petitioner was adequately informed about the meeting and had the opportunity to participate, either in person or through written submissions. The court also highlighted that the right to speak does not negate the majority's decision in a democratic setup.
Ultimately, the court upheld the No-Confidence motion, stating that the petitioner must respect the collective will of the Gram Panchayat members. The ruling reinforces the principle that elected representatives must honor the decisions made by the majority, ensuring the democratic process within local governance remains intact.
