In a significant ruling, the High Court of Bombay addressed the case of Dolphin Co-operative Housing Society Ltd. against the State of Maharashtra and the City and Industrial Development Corporation (CIDCO) . The society, representing economically weaker members, had been denied an Occupancy Certificate for nearly six years despite completing construction in July 2018. The legal question centered on whether CIDCO's refusal to grant the certificate was arbitrary and unreasonable.
The petitioners argued that CIDCO's actions were not only high-handed but also caused undue hardship to the members, who were unable to occupy their homes. They highlighted that the construction was completed as per the approved plans and that the delay in granting the Occupancy Certificate was unjustified.
The court found that CIDCO's refusal to grant the Occupancy Certificate was based on untenable grounds. It emphasized that the society had legally constructed eighteen units as per the sanctioned plans and that the addition of one member was permissible under the regulations. The court criticized CIDCO for its arbitrary approach and noted that the members of the society, who belonged to economically weaker sections, had a fundamental right to housing under Article 21 of the Constitution.
The High Court ruled in favor of the Dolphin Co-operative Housing Society, directing CIDCO to issue the Occupancy Certificate within a week. The court also imposed a cost of ₹50,000 on CIDCO for the undue hardship caused to the petitioners. This decision underscores the importance of fair administrative practices and the protection of housing rights for vulnerable communities.
