The case involves the Kalyan Dombivali Municipal Corporation (KDM Corporation) and Sanjay Gajanan Gharat , who was appointed as the Additional Municipal Commissioner (AMC) in 2015. Following allegations of corruption, Gharat was suspended by the KDM Corporation in June 2018. He challenged the suspension and the subsequent departmental inquiry in the Bombay High Court, which ruled in his favor, stating that the KDM Corporation lacked the authority to suspend him.

The KDM Corporation and the State of Maharashtra argued that the High Court erred in its judgment, asserting that the AMC, although appointed by the State Government, was an employee of the KDM Corporation and thus subject to its disciplinary actions. It rejected the High Court's interpretation that would leave serious misconduct unaddressed due to jurisdictional ambiguities.

Decision

The Supreme Court overturned the Bombay High Court's ruling, reinstating the KDM Corporation's authority to suspend Gharat and proceed with the departmental inquiry. The Court directed that the inquiry be completed within four months, while Gharat would remain under suspension until its conclusion. This decision reinforces the accountability mechanisms within municipal governance and clarifies the jurisdictional powers of local authorities over their employees.
