Court Orders Environmental Compensation for Panipat Thermal Power Station

Background

The National Green Tribunal (NGT) has ruled on a significant case concerning the Tau Devi Lal Panipat Thermal Power Station (PTPS ) located in Haryana. The case arose from a letter petition filed by Subhender , a resident of Sutana village, highlighting severe health and environmental issues caused by the improper management of fly ash from the power plant. The petition emphasized that the fly ash was contaminating air quality and affecting the health of nearby residents.

Arguments

The complainant argued that the fly ash generated by PTPS was being inadequately managed, leading to serious air quality issues and health problems in surrounding villages. The Joint Committee, formed by the NGT, conducted extensive monitoring and reported that particulate matter (PM10 and PM2.5) levels exceeded national standards, indicating significant pollution.

In response, PTPS acknowledged the issues but claimed to be taking steps to mitigate the pollution, including signing MOUs for ash disposal and implementing pollution control measures. However, they faced scrutiny for not complying with environmental regulations and for the slow pace of ash disposal.

The NGT analyzed the findings of the Joint Committee, which confirmed that air quality in the vicinity of PTPS was severely compromised, with elevated levels of harmful pollutants. The court emphasized the principle of 'Polluter Pays,' stating that PTPS must bear the costs associated with environmental remediation due to its failure to manage fly ash properly. The tribunal noted that the environmental damage was evident and required immediate action.

The court also highlighted the lack of effective measures taken by PTPS to ensure compliance with environmental standards, leading to its decision to impose a financial penalty for the damages caused.

Decision

The NGT ordered PTPS to pay an environmental compensation of ₹6,90,31,200 for the period from October 2022 to June 2024, due to the unscientific handling of fly ash. Furthermore, PTPS was directed to ensure the complete disposal of the remaining fly ash by July 31, 2027. The tribunal mandated regular monitoring and compliance reports to ensure adherence to environmental regulations and to protect the health of local communities.

This ruling underscores the importance of accountability in environmental management and reinforces the need for industries to adhere to sustainable practices to prevent pollution and protect public health.
