Court Decision
Subject : Criminal Law - Bail Applications
In a significant ruling, the High Court of Himachal Pradesh has granted bail to Rafat, the accused in a high-profile murder case involving her husband,
Rafat's counsel contended that the investigation was complete, and the trial had been delayed significantly, with only 29 out of 76 witnesses examined so far. They argued that keeping Rafat in custody served no useful purpose and violated her right to a speedy trial, a fundamental right under Article 21 of the Constitution. The prosecution, however, opposed the bail application, citing concerns that Rafat might influence witnesses or evade trial.
The court acknowledged the importance of the right to a speedy trial, referencing several Supreme Court judgments that emphasize this right as essential to justice. It noted that the trial's slow progress, with only nine witnesses examined in the past year, indicated a significant delay. The court highlighted that prolonged incarceration without trial could amount to pre-trial punishment, which is prohibited by law.
Ultimately, the High Court allowed Rafat's bail application, ordering her release on a personal bond of Rs. 2,00,000 with two sureties. The court imposed several conditions, including regular attendance at trial and restrictions on leaving the country. This decision underscores the judiciary's commitment to upholding the right to a speedy trial while balancing the interests of justice and public safety.
