The Supreme Court of India recently addressed appeals concerning the age limits for candidates appearing in the Delhi Judicial Service (DJS) and Delhi Higher Judicial Service (DHJS) examinations. The case arose from petitions challenging the validity of the upper age limit of 32 years for the DJS and the minimum age requirement of 35 years for the DHJS, which were amended shortly before the examinations scheduled for March 2022.
Petitioners argued that the amendments to the age limits unfairly disqualified candidates who would have been eligible had the examinations been conducted in 2020 and 2021, which were postponed due to procedural delays and the COVID-19 pandemic. They contended that the changes violated their rights and disrupted their career opportunities.
Conversely, the High Court of Delhi defended the amendments, asserting that the age limits were necessary to ensure that candidates possess adequate maturity and experience for judicial roles. The court emphasized that the age requirements align with recommendations from the Shetty Commission, which advocates for a minimum age for judicial appointments.
The Supreme Court recognized the unique circumstances surrounding the postponement of the examinations and the impact of the pandemic on candidates' eligibility. It noted that the last DJS examination was held in 2019, and no examinations took place in the subsequent two years, effectively barring many candidates from participating due to the newly imposed age limits.
The court agreed with the High Court's suggestion to allow candidates who would have qualified under the previous rules to participate in the upcoming examinations as a one-time measure. This decision aimed to rectify the hardship faced by candidates who were unfairly affected by the timing of the rule changes.
The Supreme Court ruled in favor of the petitioners, allowing candidates who met the age requirements for the DJS and DHJS examinations in 2020 and 2021 to apply for the 2022 examinations. The court extended the application deadlines and rescheduled the examination dates, ensuring that candidates would not face undue barriers to their judicial aspirations. This ruling underscores the court's commitment to fairness and justice in the recruitment process for judicial services.
