NEW DELHI — The Supreme Court of India on Tuesday adjourned the hearing in a batch of petitions challenging a Calcutta High Court order that invalidated thousands of appointments made through the 2016 State Level Selection Test (SLST) in West Bengal. A three-judge bench, comprising the Chief Justice of India, Justice Sanjay Kumar, and Justice K.V. Viswanathan , has scheduled the next hearing for January 15, 2025, at 2:00 p.m.
The decision pushes the final resolution further for the numerous parties involved, including the State of West Bengal, which is the lead petitioner, and thousands of teachers and non-teaching staff whose jobs are on the line.
The current proceedings stem from an appeal against the Calcutta High Court's explosive judgment dated April 22, 2024. The High Court had nullified the appointment of 25,753 teachers and non-teaching staff in state-run and state-aided schools, citing irregularities in the recruitment process conducted by the West Bengal School Service Commission (SSC). The High Court had also directed the Central Bureau of Investigation (CBI) to probe the matter further.
The State of West Bengal, along with several affected individuals and groups, subsequently filed a massive cluster of Special Leave Petitions (SLPs) in the Supreme Court, challenging the High Court's sweeping order. The apex court had earlier stayed the High Court's direction that cancelled the appointments, providing interim relief to the employees.
The case has been marked by its complexity, involving dozens of petitions and interlocutory applications. The hearing on Tuesday saw a formidable lineup of the country's top legal minds representing the various petitioners, respondents, and intervenors.
Senior Advocates including Mukul Rohatgi, Kapil Sibal, Dr. Abhishek Manu Singhvi, Jaideep Gupta, and Ranjit Kumar appeared for the petitioners, while the respondents were represented by a team led by Senior Advocates like Bikash Ranjan Bhattacharyya, Meenakshi Arora, and Maninder Singh. The presence of Solicitor General Tushar Mehta and Additional Solicitor Generals K.M. Nataraj and Suryaprakash V. Raju underscored the significance of the case for the central agencies involved.
After hearing the counsels, the bench passed a brief procedural order. The official "Record of Proceedings" stated:
"Re-list on 15.01.2025 at 02.00 p.m."
The adjournment means the interim stay on the cancellation of appointments will continue, allowing the teachers and staff to remain in their positions for the time being. However, the prolonged litigation continues to cast a shadow of uncertainty over their future and the state's education system. The next hearing is eagerly awaited, where the court is expected to delve deeper into the substantive arguments regarding the legality of the High Court's order and the fate of the contested appointments.
