In a significant move for celebrity rights in the age of generative artificial intelligence, the High Court of Delhi has granted an ex-parte ad-interim injunction in favor of South Indian superstar Allu Arjun. Justice Tushar Rao Gedela’s order marks a decisive step in curbing the unauthorized commercial exploitation of an actor’s persona through deepfakes, AI voice cloning, and branded merchandise.
The plaintiff, widely celebrated as the “Icon Star” of the Telugu film industry, approached the Court seeking to shield his identity—ranging from his voice and likeness to his signature "Pushpa" mannerisms—from commercial entities and platforms hosting derogatory or unauthorized content. The suit alleged that several defendants were engaged in the illegal sale of merchandise, providing AI-driven voice-generation tools to clone his voice, and simulating "fake calls" under his name without consent.
Counsel for the plaintiff argued that Allu Arjun’s public identity, built over decades of cinema and philanthropy, constitutes a proprietary right. The Court scrutinized substantial documentary evidence establishing not only the actor’s professional success—highlighted by the global reach of the Pushpa franchise and his recent National Film Award—but also his proactive efforts to secure his name and likeness through statutory trademark registrations.
Justice Gedela noted that the plaintiff had established a prima facie case, observing that the "unique and distinctive attributes of the plaintiff are exclusive to the plaintiff and are source identifiers."
The bench underscored the evolving nature of infringement in the digital era, particularly regarding automated technologies:
In its final order, the Court directed the defendants to immediately cease the sale of unauthorized products, the hosting of derogatory content, and the dissemination of AI-cloned voices or imagery. Furthermore, it ordered the takedown of specific URLs providing the unauthorized simulation of the actor’s persona.
This ruling stands as a stern warning to intermediaries and content creators that the unauthorized use of a person's "publicity rights" for trade or digital generation will not be tolerated. By allowing the suit to proceed with these stringent interim protections, the Delhi High Court has fortified the legal armor celebrities can use to defend their digital likenesses, providing a blueprint for future litigation regarding AI-driven identity theft.
The matter is now listed for further proceedings before the Joint Registrar on July 14, 2026, with the Court set to review the broader implications of the case on September 24, 2026.
