Subject : Service Law - Interim Orders
Amaravati, AP – The Andhra Pradesh High Court has extended a previously granted interim order for four weeks in a complex service matter dispute involving dozens of parties. The decision ensures that the status quo is maintained while the court prepares to hear the main writ appeal.
A Division Bench comprising Justice Battu Devanand and Justice A. Hari Haranadha Sarma was hearing a series of interlocutory applications (I.A. Nos. 2, 4, 5, and 6 of 2025) filed within a pending Writ Appeal (W.A. No. 1054 of 2024). The primary case, titled Merugolu Benhar vs. The State of Andhra Pradesh , challenges an earlier single-judge order and involves a significant number of individuals from various districts including Prakasam, Bapatla, and Nellore.
The State of Andhra Pradesh, represented by the Principal Secretary of Panchayat Raj and Rural Employment, is the main respondent in the appeal. The case appears to be a multi-faceted service law dispute, with various parties filing applications to either implead themselves, vacate previous orders, or suspend related administrative proceedings.
After hearing arguments from counsels representing the numerous petitioners and respondents, including Sri G.V. Shivaji and Sri V.K. Naidu, the court issued a brief but significant order.
The bench directed that the interim order, which was originally granted on May 9, 2025, in I.A. Nos. 2, 4, and 5, will be extended for an additional four weeks. The court’s order stated:
"Heard both sides. The interim order granted by this Court in i.A.Nos.2,4 and 5 of 2025, dated 09.05.2025 shall stand extended for a further period of four (04) weeks.”
This extension provides temporary relief to the beneficiaries of the original interim order, preventing any adverse actions against them until the court can delve deeper into the merits of the case.
The extension of the interim order is a procedural but critical step that maintains the existing legal protection for the concerned parties. It indicates the court's intention to thoroughly examine the complex issues raised in the main writ appeal before making a final determination. The case has been scheduled for its next hearing on September 1, 2025, when the court will likely consider the substantive arguments of the appeal.
