In a recent order, the Patna High Court exercised its judicial discretion to grant anticipatory bail to an individual accused of involvement in illegal rock mining. Justice Ajit Kumar, presiding over the matter, emphasized the significance of factual documentation in the initiation of criminal proceedings after noting the absence of the petitioner’s name in the initial report filed by forest officials.
The proceedings arose from Forest Case No. 121 of 2022, registered on December 9, 2022, under Sections 33 , 41, and 42 of the Indian Forest Act , 1927. The prosecution alleged that during a routine patrol at Karzara Protected Forest, forest guards discovered approximately 10 to 15 unidentified individuals engaged in illegal rock extraction. While the guards attempted to apprehend the suspects, the group managed to escape. Although the initial report did not name the petitioner, his name was subsequently added to the list of accused, a move the defense characterized as based solely on past criminal antecedents.
Counsel for the petitioner argued that his client had been falsely implicated in the case. The defense pointed to the report submitted before the Chief Judicial Magistrate, Gaya, by the Forest Range Officer, Wazirganj, which notably omitted the petitioner. The defense submitted that the petitioner’s inclusion appeared to be a consequence of his prior records of a similar nature rather than direct evidence of his presence at the scene of the crime.
Conversely, the Additional Public Prosecutor representing the State of Bihar vigorously opposed the prayer for relief, urging the court to maintain the custodial status of the petitioner given the serious nature of environmental offenses.
The High Court underscored that the investigative process must remain grounded in evidence rather than mere suspicion. By scrutinizing the records, the Court observed an inconsistency between the initial information provided to the magistrate and the subsequent identification of the petitioner.
Justice Ajit Kumar allowed the application for anticipatory bail, directing that the petitioner be released upon furnishing a bail bond of Rs. 10,000 with two sureties. The order includes clear, standard conditions to ensure the integrity of the ongoing investigation, including: 1. Supporting Documentation: At least one bailor must be a family member or relative providing proof of their identity. 2. Court Attendance: The petitioner must appear before the trial court on every hearing date; failure to do so without valid reason will lead to the cancellation of the bail bond. 3. Witness Integrity: The petitioner is strictly barred from inducing, promising, or threatening any witnesses involved in the case. 4. Condition of Conduct: The petitioner must desist from committing any further criminal offenses, or risk revocation of the bail.
This decision serves as a reminder of the judiciary's role in ensuring that criminal charges are supported by concrete evidence, particularly in instances where suspects are brought into the ambit of a case well after the initial discovery of the alleged offense.
