The case involves a dispute over a real estate transaction between the plaintiffs and the defendants. The plaintiffs had entered into an agreement with the defendants to purchase a property, but the defendants later refused to execute the sale deed. The plaintiffs filed a suit seeking specific performance of the contract and, alternatively, the return of the advance payment made to the defendants.
The plaintiffs argued that they had paid a total of Rs.11,00,000 as advance to the defendants, and that the defendants had refused to execute the sale deed despite repeated demands. The defendants, on the other hand, claimed that the plaintiffs had only paid Rs.5,00,000 as advance and that they were not ready and willing to pay the remaining balance within the stipulated time frame.
The appellate court examined the evidence and found that the plaintiffs had indeed paid only Rs.5,00,000 as advance, as per the defendants' claim. The court also held that the sale agreement was a valid and enforceable document, despite the absence of the signature of the second defendant.
However, the court found that the plaintiffs were not entitled to the relief of specific performance, as they had failed to demonstrate their readiness and willingness to perform their part of the contract within the stipulated time frame. The court noted that the plaintiffs had filed a previous suit for permanent injunction, which indicated that the cause of action for the present suit was available to them earlier, and thus, the present suit was barred under Order II Rule 2 of the Code of Civil Procedure.
The appellate court partially allowed the appeal, granting the plaintiffs the alternate relief of refund of the advance payment of Rs.5,00,000, along with interest at the rate of 9% per annum from the date of the suit until the date of the decree, and post-decree interest at the rate of 6% per annum until the date of realization. The court, however, upheld the trial court's decision to dismiss the plaintiffs' claim for specific performance of the contract.
