CUTTACK, ODISHA – The legal community across Odisha is set to bring judicial proceedings to a standstill, observing a statewide 'pen-down' strike on Wednesday following the brutal murder of Advocate Pitabash Panda, a senior lawyer and an elected member of the Odisha State Bar Council (OSBC). The protest, called by the OSBC and supported by numerous bar associations, including the Orissa High Court Bar Association (OHCBA), frames the killing not merely as a criminal act but as a direct attack on the judiciary's foundations and the safety of legal practitioners.
Advocate Panda, 52, was shot dead at close range by two unidentified, bike-borne assailants on the night of Monday, October 6th, near his residence in Berhampur. Despite being rushed to the MKCG Medical College and Hospital, he succumbed to his injuries. The daylight murder of a prominent legal figure has sent a palpable chill through the state's legal circles, prompting a swift and unified response.
A Unified Cry for Justice from the Bar
In an emergent virtual meeting held on Tuesday, the Odisha State Bar Council passed a unanimous resolution condemning the killing in the strongest possible terms. The resolution articulates a sentiment of profound shock and anger, stating, “This dastardly act has sent shockwaves through the entire legal fraternity, underscoring the grave threats faced by advocates in the discharge of their professional duties and posing a direct assault on the independence of the Bar and the rule of law.”
The OSBC's chairman, Sitanshu Mohan Dwibedy, who also serves as a member of the Bar Council of India (BCI), emphasized the systemic nature of the threat. “This barbaric act is not just an attack on an individual, but on the entire legal system," Dwibedy declared. "It demands immediate and serious response from the state.”
The Council has put forth a set of stringent demands to the government, calling for: 1. A High-Level Judicial Inquiry: To ensure an impartial and thorough investigation into the murder, independent of regular police procedure. 2. ₹1 Crore Compensation: For the bereaved family of Advocate Panda. 3. Statewide 'Pen-Down' Protest: Urging every advocate in Odisha to abstain from all court work on Wednesday as a mark of respect and a symbol of protest.
The call to action has been widely heeded. The Orissa High Court Bar Association has scheduled a Joint General Body Meeting on Wednesday morning, to be followed by a peaceful rally. Support has also poured in from regional bodies, including the Ganjam District Bar Association, to which Advocate Panda belonged, and the Bhubaneswar Bar Association. In a significant move, these associations have formally requested their respective District Judges and Judicial Officers to cooperate with the protest by refraining from passing adverse orders due to the absence of lawyers, seeking judicial solidarity for their cause.
National Outrage and the Larger Debate on Advocate Protection
The incident has resonated far beyond Odisha, drawing a sharp condemnation from the Bar Council of India (BCI), the apex body for lawyers in the country. BCI President Manan Kumar Mishra condemned the "reprehensible crime" and amplified the demands for a robust state response. The BCI has specifically called for the constitution of a Special Investigation Team (SIT) to probe the murder, immediate witness protection for anyone who comes forward with information, and a time-bound prosecution to ensure the perpetrators are swiftly brought to justice.
Panda's murder has reignited the long-standing and urgent debate over the need for a specific Advocates' Protection Act. Legal professionals argue that they are uniquely vulnerable due to the nature of their work, often dealing with contentious disputes, high-stakes litigation, and emotionally charged clients. The killing of a Bar Council member is seen as a grim testament to this vulnerability, highlighting that even those at the helm of the legal fraternity are not safe. An Advocates' Protection Act would aim to create specific offenses and stricter penalties for acts of violence, intimidation, or coercion against lawyers in the line of duty, providing a legal shield that many feel is long overdue.
The Investigation and Political Dimensions
While the legal community mobilizes, a police investigation is underway. Berhampur SP Saravana Vivek M confirmed that three special teams, comprising senior officers, have been formed to track down the assailants. He stated, “We are probing from all possible angles. Our first priority is to identify the shooters and nab them.” Investigators are currently scrutinizing CCTV footage from the area and have conducted raids on several potential hideouts. An autopsy report suggested the fatal shot was fired from point-blank range, indicating a premeditated and execution-style killing.
The incident also carries political undertones. Advocate Panda was a well-known public figure who had recently joined the Bharatiya Janata Party (BJP) after stints with the CPI(M) and the Congress. The state's new Chief Minister, Mohan Charan Majhi, also from the BJP, has assured that the government will not tolerate such "heinous crimes" and promised "exemplary punishment to the culprits as per law."
As the state's courts fall silent on Wednesday, the message from Odisha's legal fraternity is clear and unwavering: the murder of one of their own is an attack on the very institution of justice they are sworn to uphold. The outcome of the investigation and the government's response to their demands will be closely watched, not just by lawyers in Odisha, but by the entire legal community across India, as a barometer of the state's commitment to protecting its legal protectors and preserving the sanctity of the rule of law.
