Chhattisgarh High Court Denies Bail in PMLA Case, Cites Seriousness of Economic Offense

Bilaspur, Chhattisgarh – The High Court of Chhattisgarh at Bilaspur has rejected the regular bail application of Arvind Singh , accused in a case registered by the Directorate of Enforcement (ED) under the Prevention of Money Laundering Act (PMLA), 2002. Justice Arvind KumarVerma , presiding over the matter, delivered the order on February 6, 2025, emphasizing the gravity of economic offenses and the stringent conditions for bail under the PMLA.

Case Background: Allegations of Liquor Syndicate and Money Laundering

The case stems from an Enforcement Case Information Report (ECIR No. RPZO/04/2024) dated April 11, 2024, initiated by the ED, Raipur, concerning offenses under Sections 3 and 4 of the PMLA. Arvind Singh , a former Bhilai Steel Plant employee, was arrested on July 1, 2024, accused of being a key player in a liquor syndicate that allegedly caused a loss of approximately Rs. 2161 crores to the government.

The ED's investigation alleges that Singh , along with other accused, was involved in collecting commissions and supplying unaccounted liquor through government liquor shops. This investigation is linked to a predicate offense FIR No. 04/2024 registered by the Anti-Corruption Bureau (ACB), Raipur, under various sections of the Indian Penal Code (IPC) and the Prevention of Corruption Act (PC Act).

Arguments for Bail: Prolonged Incarceration and Right to Speedy Trial

Shri Sunil Otwani , counsel for the applicant, argued for bail based on several grounds, primarily emphasizing the prolonged pre-trial incarceration of his client. He contended that the investigation against Singh was complete, with the ED having already filed a prosecution complaint. Otwani cited the applicant's custody period in a previous, related ECIR (ECIR/RPZO/11/2022) which was quashed by the Supreme Court, highlighting that the current ECIR was based on similar allegations.

Drawing upon precedents like Ramkripal Meena Vs. Directorate of Enforcement and Manish Sisodia Vs. CBI and ED , the applicant's counsel argued that bail should be granted considering the protracted trial, the applicant's cooperation, and the fundamental right to a speedy trial under Article 21 of the Constitution. He further argued that the twin conditions under Section 45 of the PMLA could be relaxed in light of prolonged incarceration and the applicant's willingness to cooperate.

ED's Counter-Arguments: Gravity of Offense and Risk of Evidence Tampering

Dr. Saurabh Kumar Pandey , representing the ED, vehemently opposed the bail application. He asserted the severity of the economic offense, pointing to the FIR alleging a loss of Rs. 2161 crores due to the liquor syndicate. The ED argued that Arvind Singh was a central figure in the syndicate, instrumental in collecting commissions and managing logistics for the illegal liquor trade.

The ED presented WhatsApp chats and digital evidence suggesting Singh 's involvement, claiming he and an associate earned approximately Rs. 40 crores from illicit liquor sales. Dr. Pandey argued that releasing Singh on bail would pose a risk of evidence tampering and witness influence, potentially hindering the ongoing investigation into the larger conspiracy and recovery of proceeds of crime. He emphasized the mandatory twin conditions under Section 45 of the PMLA, citing judgments like Gautam Kundu Vs. Directorate of Enforcement and Vijay Madanlal Choudhary Vs. Union of India , which underscore the stringent requirements for bail in PMLA cases.

Court's Rationale: PMLA Conditions Prevail Over Speedy Trial Argument

Justice Verma , after reviewing the submissions and case records, sided with the prosecution. The Court acknowledged the applicant's arguments concerning prolonged incarceration and the right to a speedy trial. However, it emphasized that in cases under the PMLA, the stringent twin conditions of Section 45 must be satisfied.

The judgment highlights the gravity of the allegations against Arvind Singh , stating:

> "After careful analysis of the material available on record which goes to show that there is prima facie involvement of the applicant in the crime in question and the charge sheet has been filed. Since, the allegations against the applicant are serious in nature and there was material to infer his involvement in serious crimes."

While acknowledging observations made by the Supreme Court regarding arrests not being based on "whims and fancies" of ED officers, the High Court found sufficient prima facie material to indicate Singh 's involvement in money laundering and the liquor syndicate.

Bail Rejected: Twin Conditions of PMLA Not Met

Ultimately, the Chhattisgarh High Court concluded that Arvind Singh failed to satisfy the twin conditions for bail under Section 45 of the PMLA. The court held that there were no reasonable grounds to believe that the applicant was not guilty of the offense, nor was it satisfied that he would not commit further offenses while on bail.

Consequently, the bail application was rejected, keeping Arvind Singh in judicial custody and reinforcing the stringent bail regime under the PMLA, particularly in cases involving serious economic offenses. The judgment underscores the judiciary's continued emphasis on tackling money laundering and economic crimes, even while acknowledging concerns regarding pre-trial incarceration and the right to speedy trial.
