Bihar Caste Survey Data Break-up Should Be Made Public: Supreme Court

The Supreme Court of India has directed the Bihar government to make the break-up of the caste survey data public. The bench of Justices Sanjiv Khanna and Dipankar Datta said this would allow those affected by the survey's findings to challenge them.The court was hearing a petition filed by the NGO Ek Soch Ek Prayas, which challenged the Bihar government's decision to increase reservation from 50% to 70% based on the survey's findings.The petitioner's counsel, Raju Ramachandran, argued that the survey was not transparent and that the data should be made public so that people could challenge any inferences drawn from it.The Bihar government's counsel, Shyam Divan, said the survey was available in the public domain and had been tabled in the state legislature. However, he said the data was still being worked on and information was made public as and when an analysis was completed.The court said it would be a problem if the data was put out in the public domain selectively. It said the break-up of data should normally be made available because if someone wants to challenge a particular inference, that chance should be given.The court fixed the hearing in February.
