Ahmedabad, Gujarat – The High Court of Gujarat has granted regular bail to a woman accused of sending anonymous bomb hoax emails to various organizations. In its order, the single-judge bench of Justice Nikhil S. Kariel observed that the applicant appeared to be a "disturbed person" and that the investigation was complete, making her continued detention unnecessary.
The applicant, Rene Joshilda Goldwin Joseph, was seeking regular bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita ( BNSS ), 2023, following the filing of a chargesheet against her.
The case originates from an FIR registered at Bopal Police Station, Ahmedabad, where Ms. Joseph was charged under Section s 351 (3) (making threatening communication) and 353(1)(B) (hoax threat) of the Bharatiya Nyaya Sanhita (BNS), along with Section 66(C) of the Information Technology Act . The primary allegation was that she sent anonymous emails to several organizations, falsely claiming that bombs had been planted on their premises. These hoaxes led to significant disruption and harassment for both the police and the targeted organizations.
Ms. Joseph has been in custody since June 28, 2025.
Counsel for the Applicant, Mr. Vishalkumar Tomar, argued that considering the nature of the allegations and the role attributed to his client, she should be granted bail. He emphasized that since the chargesheet has already been filed, there would be no useful purpose served by keeping her incarcerated indefinitely. He also affirmed her willingness to comply with any conditions imposed by the court.
The State, represented by Additional Public Prosecutor Mr. L.B. Dhabi, strongly opposed the bail application. He contended that the serious nature of the offence and the applicant's role, as detailed in the chargesheet, warranted the dismissal of her plea.
After hearing both parties, Justice Kariel exercised the court's discretion to grant bail. The decision was based on a holistic consideration of several factors, without delving into a detailed examination of the evidence.
