In a significant move for the hospitality sector, the Bombay High Court has stepped in to protect the brand equity of one of India’s premier hotel chains. Justice Sharmila U. Deshmukh, presiding over the Commercial Division, granted an ad-interim injunction against "Orchid Hotel and Hostel," finding that its operations infringed upon the long-established trademark rights of Kamat Hotels India Limited.
Kamat Hotels, a veteran in the hotel industry established in 1986, has been operating its renowned five-star "The Orchid/Orchid" hotels since 1995. The Plaintiff argued that their brand is synonymous with premium hospitality, backed by years of intensive advertising and a robust turnover.
The conflict emerged in December 2023, when Kamat Hotels discovered a new entrant—"Orchid Hotel and Hostel"—operating under a deceptively similar name. Despite a formal cease and desist notice issued by the Plaintiff, the defendant continued its operations, prompting the current litigation.
The Plaintiff contended that the word "Orchid" serves as the core identifier of their services. They demonstrated through extensive evidence—including registrations dating back to 1997 and 2006—that their trademark has achieved immense distinctiveness.
The Defendants, meanwhile, offered no substantial defense, according to the court, for mimicking the Plaintiff’s established mark. Highlighting the digital nature of the infringement, Kamat Hotels pointed out that the infringing entity was leveraging various online booking platforms (Defendants 2-6) to attract customers, further diluting the Plaintiff's hard-earned brand reputation.
Justice Deshmukh was quick to note that the proprietary rights of the Plaintiff were prima facie sound. The court observed that while the Defendant added descriptive terms like "Hotel and Hostel" to their name, the central mark remained identical to the Plaintiff’s registered trademark.
The court emphasized the necessity of preventing the irreparable harm that would occur if the Defendant’s unauthorized use continued during the pendency of the suit. Consequently, the court ordered not only the Defendant to stop using the mark but also directed the aggregator websites to remove the infringing listings immediately.
"The Defendant No. 1 has copied the Plaintiff’s trade mark 'ORCHID' and the addition of the word Hotel and Hostel is descriptive."
"There is no defence which is prima facie available for the Defendant for using a deceptively similar trade mark as that of the Plaintiff which registered mark has achieved distinctiveness by reason of long standing continuous user."
"Considering that the booking of Defendant No. 1 can be done from the Defendant Nos. 2 to 6’s website, ad-interim relief is required to be granted against Defendant Nos. 2 to 6."
By granting this ad-interim relief, the Bombay High Court has reaffirmed its commitment to protecting intellectual property, particularly where digital platforms are involved in propagating trademark violations. The order mandates that the Defendant and the associated online platforms scrub all references to the infringing name from their media. This case sends a stern message: in the digital age, brand identity is a protected asset, and unauthorized encroachment will be met with immediate judicial intervention.
The matter is set for further consideration on December 3, 2025.
