In a decisive move to protect intellectual property within the hospitality sector, the Bombay High Court has granted an ad-interim injunction against the entity operating as "Orchid Hotel and Hostel." The ruling, delivered by Justice Sharmila U. Deshmukh, mandates the immediate removal of the infringing entity from all third-party booking platforms, shielding Kamat Hotels India Limited from potential brand dilution.
Kamat Hotels India Limited, an established player in the luxury hotel market since 1995, approached the court alleging that its trademark, "ORCHID/THE ORCHID," was being flagrantly misused. The Plaintiff asserted that they have invested heavily in building a reputation through extensive advertising and a long-standing history of services, dating back to their first registration applications in 1997.
The conflict arose in December 2023, when Kamat Hotels discovered an entity operating under the name "Orchid Hotel and Hostel." Despite a formal cease-and-desist notice issued by the Plaintiff, the Defendant remained silent, continuing to market their services through various online travel aggregators.
During the proceedings, the court performed a direct comparison of the competing marks. Justice Deshmukh noted that the word "Hotel and Hostel" added to the Defendant's branding was merely descriptive, doing little to mitigate the likelihood of consumer confusion.
"The rival marks are 'Orchid' and 'Orchid Hotels and Hostel'," the court observed. "The Defendant No. 1 has copied the Plaintiff’s trade mark 'ORCHID' and the addition of the word Hotel and Hostel is descriptive."
The court further emphasized that because Kamat Hotels enjoys a registered trademark with years of continuous use, the weight of legal protection lies heavily in their favor. The lack of a response from the Defendant further weakened their position, leaving the court with no prima facie evidence of a legitimate defense.

The order is comprehensive in its scope. Not only is the primary Defendant restrained from using the infringing trademark, but the court has also issued a directive to the associated online booking platforms (Defendants 2-6) to immediately take down any listings relating to "Orchid Hotel and Hostel."
This decision serves as a stern reminder to emerging businesses that descriptive suffixes do not provide a "safe harbor" for copying established trademarks. As the litigation proceeds toward its final disposal, the ad-interim relief ensures that the integrity of the "Orchid" brand remains intact while the Plaintiff’s proprietary rights are upheld. The matter is currently listed for further consideration on December 3, 2025.
