Background

The case involved Ramchandra s/o Amrutrao Niwane, who was serving as a Talathi (village revenue officer) in Eklara village. Gajanan Bhimrao Kakde , a villager, accused Ramchandra of demanding a bribe of ₹5,000 to record the name of Kakde 's mother in the crop statement for a land parcel.

The prosecution claimed that Ramchandra demanded the bribe and accepted ₹1,000 from Kakde . However, Ramchandra 's defense argued that there was no evidence of a demand, and the mere possession of the money was not sufficient to convict him. The Bombay High Court allowed the appeal and acquitted the accused, Ramchandra , of the offenses under Sections 7 and 13(2) of the Prevention of Corruption Act, 1988. The court found the sanction granted to be invalid and quashed the judgment and order of conviction and sentence passed by the trial court.
