Bharat Rashtra Samithi (BRS) Leader Seeks Relief in Delhi Excise Policy Case

Bharat Rashtra Samithi (BRS) leader K Kavitha has moved the Rouse Avenue Court in Delhi, seeking a default bail in the Central Bureau of Investigation (CBI) case connected to the alleged Delhi excise policy scam.

Kavitha 's lawyer, Advocate Nitesh Rana , told the court that she is seeking the default bail on the grounds that the chargesheet filed by the CBI is incomplete and defective.

The court has issued a notice to the CBI and listed the matter for further hearing on July 12.

Defective Chargesheet and Delayed Filing

Kavitha 's bail application states that while considering the chargesheet for the purpose of cognizance on July 6, the court had specifically noted that the chargesheet was defective.

The application further argues that Kavitha should be granted default bail as the CBI has failed to file a complete chargesheet within the mandatory period of 60 days.

Kavitha 's Previous Bail Pleas Rejected

Kavitha 's earlier regular bail applications in the corruption and money laundering cases linked to the alleged Delhi liquor policy scam were dismissed by both the trial court and the Delhi High Court.

The central agencies probing the case, the CBI and the Enforcement Directorate (ED), had opposed Kavitha 's bail pleas, arguing that she is powerful enough to influence witnesses.

Allegations Against Kavitha

The case against Kavitha is based on the FIR filed by the CBI on the complaint of the Lieutenant-Governor of Delhi. The FIR alleges multiple irregularities in the Delhi excise policy-2021-22, which was later withdrawn by the Aam Aadmi Party (AAP) government.

The agencies have alleged that Kavitha played a "big role" in arranging money for the AAP and that she was the proxy partner of liquor company Indospirit, which gained profits in the excise policy.

Kavitha was first arrested by the ED on March 15 and later by the CBI on April 11 in the matter.

Court Reserves Order on Cognizance of Third Chargesheet

In a related development, the Rouse Avenue Court has also reserved its order on the point of taking cognizance of the third supplementary chargesheet filed by the CBI in the case. The order will be pronounced on July 15.

The court's decision on the default bail plea and the cognizance of the chargesheet will be crucial in the ongoing investigation into the alleged Delhi excise policy scam.
